TERMS OF USE, SECURITY POLICY, AND BOOKING TERMS
Effective Date: August 7th, 2025.
These Terms apply to: (1) use of this website and related pages; (2) communications with Witch Kitty Records LLC and Witch Kitty Studios (“WKR,” “we,” “us”); (3) bookings, services, sessions, and delivery of work products; and (4) entry to any WKR-controlled premises.
By accessing the site, contacting us, submitting materials, booking services, or entering our premises, you agree to these Terms.
1) Authorized Communications
Official contacts are those published on this website contact page. Use those channels only. Unlisted numbers/accounts are not authorized.
We may require identity verification before we:
(a) confirm bookings; (b) discuss pricing/contracts; (c) release files; (d) provide session details or location information.
Verification methods may include invoice number, confirmation code, ID match, or a call initiated by WKR to a verified number.
2) Prohibited Conduct (Zero Tolerance)
The following conduct is prohibited toward WKR, our artists, clients, staff, contractors, family members, or associates:
harassment, threats, intimidation, coercion, extortion
stalking, surveillance, tracking, repeated or unwanted contact
number spoofing, impersonation, fraudulent booking attempts
doxxing, publishing private information, directing others to harass
attempts to access accounts, files, devices, networks, or premises without authorization
disruption of sessions or operations, including review/extortion tactics or coordinated reporting/brigading
contact after a clear request to stop (“no-contact breach”)
3) Enforcement Actions
If WKR determines prohibited conduct has occurred or is likely to occur, we may take any of the following actions without notice:
terminate communications
cancel bookings/services and refuse future service
refuse entry to WKR premises and remove individuals from premises
withhold delivery pending payment or compliance with these Terms
retain deposits as liquidated damages where permitted
charge disruption, security, cleanup, or administrative fees where applicable
preserve and disclose records to platforms, payment processors, counsel, or law enforcement
pursue civil remedies, including injunctive relief and damages
WKR’s decision regarding safety and access is final.
4) Security Logging and Monitoring
To protect operations and personnel, WKR may maintain internal security records, including:
communications (emails, messages, voicemails)
timestamps, call metadata, and contact attempts
transaction records, invoices, and booking identifiers
IP/device/browser logs where available through site hosting and service providers
incident documentation
These records may be used for dispute resolution, fraud prevention, and legal enforcement.
5) Website Use
You agree not to:
interfere with site operation, attempt unauthorized access, or introduce malware
scrape, copy, or reuse site content for commercial purposes
use the site to violate rights, laws, or these Terms
The site is provided “AS IS” and “AS AVAILABLE.” WKR makes no warranties regarding availability, accuracy, or uninterrupted operation.
6) Intellectual Property
All website content (text, graphics, logos, images, audio/video, designs, layout) is owned by WKR or used with permission. You may view and share links for personal, non-commercial use. You may not reproduce, redistribute, or exploit content without written permission.
7) Submissions
If you submit files or materials (audio, stems, video, artwork, designs, text), you represent you have the legal rights to submit them.
Unsolicited submissions are not confidential unless WKR agrees in writing.
For booked services, you grant WKR a limited license to use submitted materials solely to perform the requested services and deliver work products.
BOOKING AND SERVICE TERMS
8) Booking Confirmation
A booking is confirmed only when WKR has, in writing:
(a) accepted the scope/deliverables; and (b) confirmed the schedule; and (c) received any required deposit/payment; and (d) completed any required verification.
9) Payment Terms
Deposits reserve time and are generally non-refundable except where required by law or explicitly stated in writing.
Final deliverables are released only after full payment clears.
Client is responsible for third-party payment platform fees.
Chargebacks/Payment Disputes: If a chargeback is initiated after work begins, WKR may pause work and delivery and submit relevant records to the payment processor. Future service may be refused.
10) Cancellations and Rescheduling
Unless otherwise agreed in writing:
Rescheduling requires at least 48 hours notice.
Late cancellations/reschedules may forfeit deposit.
No-shows and extreme lateness may be billed as a completed session.
11) Disruption and Safety Termination
WKR may terminate a session immediately for safety or policy violations, including harassment, threats, unauthorized persons, or refusal to comply with studio rules.
If a session is terminated for cause, fees remain due for reserved time and any additional costs (security/cleanup/administrative).
12) Studio Access and Location Control
Access is limited to verified individuals on the session list.
Studio location details may be withheld until booking is confirmed and verification is complete.
13) Confidentiality / Non-Disclosure
Client agrees not to publish or distribute any unreleased materials, rough mixes, session media, private communications, or project files without written authorization.
Unauthorized disclosure may result in takedown actions and liability for damages and enforcement costs.
14) Revisions
Unless otherwise agreed in writing:
Revisions are limited to reasonable adjustments consistent with the approved scope.
Major changes or additional deliverables require a new quote.
Timelines may shift if client materials are incomplete or approvals are delayed.
15) Portfolio and Credits
Unless the client requests confidentiality in writing before work begins, WKR may credit its work and use limited excerpts/stills for portfolio/promotion after release or after a reasonable period.
16) No Guarantees
WKR does not guarantee audience growth, placements, distribution outcomes, editorial acceptance, revenue, or algorithmic performance.
LEGAL
17) Limitation of Liability
To the maximum extent permitted by law, WKR is not liable for indirect, incidental, consequential, special, or punitive damages arising from site use or services.
18) Governing Law / Venue
These Terms are governed by the laws of the State of California. Venue will be state or federal courts serving Sacramento, California, unless otherwise required by law.
WKR may seek injunctive relief for harassment, stalking, doxxing, fraud, or IP misuse.
19) Changes
WKR may modify these Terms at any time by posting an updated version with a new effective date.
20) Privacy & Personal Information
We collect only the information needed to operate this site and respond to inquiries — such as your name, email, phone number, and any details you provide when contacting us or booking. We use it to reply to you, manage bookings, and keep records as described in Section 4. We do not sell your personal information.
21) Cookies
This website uses cookies and similar technologies. We use essential cookies required for the site to function (for example, a session identifier). We also embed third-party content such as YouTube, which may set its own cookies when you interact with videos. You can control or delete cookies through your browser settings; disabling some cookies may affect how parts of the site work.
22) Third-Party Services
Embedded media (such as YouTube) and any streaming or booking links are governed by those providers’ own privacy policies, which we do not control.
23) Your Choices & California Rights
